This Car Rental Agreement (the “Agreement”) is entered into between the undersigned party, hereinafter referred to as the “Renter,” and Pesa Car Rental, hereinafter referred to as the “Company,” collectively referred to as the “Parties,” for the rental of a vehicle (the “Vehicle”) as described below.
The Renter agrees to return the Vehicle in the same condition as it was received, with normal wear and tear expected.
The Renter will be responsible for any damage, loss, or excessive cleaning required beyond normal wear and tear, and the associated costs will be charged to the Customer.
The Renter shall be responsible for all fuel expenses incurred during the rental period and shall return the Vehicle with the same fuel level as it was received.
Physical Damage (the actual tangible damage) to the Vehicle in the event of collision or comprehensive events, or theft of the Vehicle (and Related Costs) during the period of the booked trip, regardless of who is found to be at fault for the damage
Claims processing costs up to $150 per claim — if a third party accepts total fault for the claim and that third party’s insurer processes it on behalf of the company without substantial processing by the Companies claims administrator, we’ll refund the renter’s processing fee
The actual cash value (ACV) of a Vehicle if there’s Physical Damage that results in it being a total loss, plus Related Costs, minus the salvage value, if any.
The Renter agrees not to sublet or transfer the Vehicle to any third party without the prior written consent of the Company.
The Renter shall comply with all applicable Terms of service, laws, rules and regulations relating to the use and operation of the Vehicle.
The Company shall provide a well-maintained Vehicle in good working condition, with valid registration and insurance coverage.
The Company shall make reasonable efforts to ensure the availability of the reserved Vehicle at the agreed pick-up location and time.
The Vehicle is insured by the Company with comprehensive and third-party liability coverage.
The Renter is responsible for any deductible amount specified in the insurance policy in the event of an accident, loss, or damage to the Vehicle during the rental period.
The Renter may choose to purchase additional insurance coverage from other insurance Company or may also have the option to use their own personal auto insurance policy or credit card coverage to supplement or replace the company’s insurance. However, it’s important for customers to check the terms and conditions of their personal policies or credit card coverage to understand the extent of coverage and any limitations.
Either Party may terminate this Agreement with written notice to the other Party.
In the event of termination, the Renter shall return the Vehicle to the designated return location promptly.
This Agreement shall be governed by and construed in accordance with the laws of California.
Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of California.
This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements, oral or written, relating to the subject matter hereof.
