These Terms of Service (the “Terms”) govern the use of services provided by Pesa Car Rental, hereinafter referred to as the “Company,” and apply to all individuals or entities (the “Customers” , Renters, “Users”) utilizing the Company’s car rental services. By accessing or using the Company’s services, Customers agree to be bound by these Terms.

1. Rental Agreement:

  • Customers must enter into a separate Rental Agreement with the Company for each vehicle rented. The Rental Agreement specifies the terms, conditions, and obligations related to the rental, including but not limited to the rental period, rental rates, vehicle details, insurance coverage, and return conditions.

2. Eligibility:

  • Customers must meet the minimum age requirement and possess a valid driver’s license issued by the appropriate authorities in their jurisdiction.
  • Customers must provide accurate and complete information during the reservation and rental process, including personal identification, contact details, and payment information.

3. Vehicle Usage:

  • Customers shall use the rented vehicle solely for legal and authorized purposes.
  • Customers shall not use the rented vehicle for any prohibited activities, including but not limited to illegal transportation, towing, racing, off-road use (unless explicitly permitted), or any action that violates traffic laws or regulations.

4. Reservation and Cancellation:

  • Reservations are subject to availability and are confirmed based on the Company’s discretion.
  • Customers must provide accurate information when making a reservation.
  • Cancellations must be made within the designated timeframe specified by the Company. Failure to cancel within the specified timeframe may result in cancellation fees or charges.

5. Rental Fees and Payments:

  • Customers shall pay the rental fees as per the rates specified in the Rental Agreement and any additional charges incurred during the rental period, including fuel charges, mileage fees, tolls, fines, or damages.
  • Customers shall provide a valid payment method and authorize the Company to charge the applicable fees, violations and deposits.

6. Insurance Coverage:

  • The Company provides insurance coverage for the rented vehicle as specified in the Rental Agreement.
  • Customers will be responsible for a deductible amount in the event of an accident, loss, or damage to the vehicle. Customers have the option to purchase additional insurance coverage to reduce or eliminate the deductible, subject to additional charges.
  • Customers may also have the option to use their own personal auto insurance policy or credit card coverage to supplement or replace the rental company’s insurance. However, it’s important for customers to check the terms and conditions of their personal policies or credit card coverage to understand the extent of coverage and any limitations.

7. Vehicle Condition:

  • Customers shall return the rented vehicle in the same condition as received, with normal wear and tear expected.
  • Customers are responsible for any damage, loss, or excessive cleaning required beyond normal wear and tear, and the associated costs will be charged to the Customer.

8. Termination:

  • The Company reserves the right to terminate or suspend services to any Customer in the event of a violation of these Terms, illegal activities, non-payment, or any action that poses a risk to the Company or its vehicles.

9. Limitation of Liability:

  • The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of its services or any loss or damage to personal belongings left in the rented vehicle.

10. Governing Law and Jurisdiction:

  • These Terms shall be governed by and construed in accordance with the laws of state of California.
  • Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the state of California.

11. Confirming Your Booking and Taking Payment:

When you make a booking on our website, in most cases, it is confirmed immediately using the email address you provided us at the time of the booking. Sometimes, however, we may have to confirm if the selected car is available. In that case, we will let you know right away and block the money on your payment car temporarily. As soon as the car is confirmed, we will let you know and deduct the payment from your card. Very rarely, if we can’t confirm if a car is available, we will let you know and unblock the money on your card. When you book a car with us, we will email you to confirm its availability within 48 hours of booking and send you a booking confirmation. You will have a contract once your booking is confirmed and the payment has been made. When you make the booking, all correspondence will be made to the address provided. To dispel any doubts, nothing in these terms entitles any third party or any rights or benefits pursuant to the Contracts (Right of Third Parties) Act 1999.

12. Accuracy of Information:

We strive to ensure that all information on this website is accurate. However, neither we nor any of our affiliates, suppliers, or agents can be held responsible by you for inaccurate information. It is your sole responsibility to evaluate the completeness, accuracy, and usefulness of all the information present on this website. You must present the voucher/e-voucher at the time of picking up your vehicle. We cannot be held responsible in case you do not have the voicer/e-voucher to present. We will not be held responsible for anyone driving under the influence of drugs/alcohol, causing willful damage, driving without due attention, or driving off-road. This list is not exhaustive, and you will accept full responsibility in the event of such claims.

13. Fuel & Deposits at the Car Hire Counter:

Most car rental companies keep a deposit at the beginning of the rental to cover any charges incurred during the rental, cover excess liability, and in some cases, fuel. You must have a valid credit card with funds on it to make a deposit if required. Furthermore, the card must be in the main driver’s name. Make sure you check with us which cards are accepted at the time of making the booking. If you still have questions, please contact us. Given that you return the car in the same state as rented, the deposit will be refunded after the car is dropped off.

14. Minimum/Maximum Age Limitations:

The minimum age to rent a car with us is 21, while the maximum age is 65. In that case, we will let you know when the driver submits their correct driver age along with the booking request. If you have any questions or concerns in this regard, don’t hesitate to contact us.

15. Additional Drivers:

We may charge an additional fee for additional drivers. However, please confirm with us at the time of making the booking.

16. Daily Rate Calculations:

The price of hiring will be calculated at the time of booking, and it is calculated on a 24-hour basis. If you wish to extend the period of hire after you have picked up the car, or if you drop it off later than the stated time, then extra time may be charged by the company at the local daily rate. It may be higher than the rate charged at the time of the booking. We may also charge a penalty for a late drop-off, the details of which will be mentioned in your contract.

17. Late Pick-ups/ Early Drop-offs:

You will have the details about when your rental starts and finishes according to the pick-up and drop-off dates and times. For any unused time, it is unfortunate that we cannot provide any refund if a car is picked up late or dropped off early. If you cannot pick up the car at the agreed time and date, we urge you to contact us as soon as possible. If you do not, there is no guarantee that the car will remain available for you. Furthermore, we will not extend any refund to you either.

18. Out-of-Hours Service:

In case you have rented a car with us and the pick-up falls out of the service hours, there may be a charge that applies. We will confirm whether a charge applies when you confirm your pick-up times in your booking request. Minimum/Maximum A

19. Car Cleaning:

Our client’s safety is our top priority, and we ensure all our clients receive clean vehicles. All our cars follow standard operating procedures for cleaning before renting out a vehicle, including a complete vehicle cleaning on the exterior and interior and disinfecting surfaces. This includes the steering wheel and controls, door handles, all buttons on the infotainment system, climate control knobs, cup holders, seat adjustments, armrests, seat belt buckles, trunk area, and more. Furthermore, the exterior of the vehicle is thoroughly washed. We vacuum and wipe the interior of all our cars according to CDC guidelines. We use a variety of commercial-grade products to clean and disinfect the interior of the cars. Our employees who wash and disinfect cars wear masks and gloves. Moreover, ionic water is used to dry the car spot-free and eliminate the use of towels to decrease the spread of contaminants.

20. Cleaning /Valeting Fee:

While we prioritize your health and safety, we expect our clients to return the vehicle acceptably and cleanly. We understand that the car can become dirty when used. However, if we receive a vehicle dirtier than expected, we will charge a valeting fee which depends on how dirty the car is. In addition, if we receive our vehicle in a condition that is the result of irresponsible or abusive behavior, a cleaning fee of $250 is applicable.

21. Smoking in Vehicles:

We maintain completely smoke-free vehicles and do not allow smoking in our rental vehicles. Our non-smoking policy is implemented to ensure that all our clients can enjoy a clean car and drive comfortably. In case of our non-smoking policy violation, a violation fee will be applicable.
This policy covers the use of but is not limited to, any tobacco or tobacco-related products, marijuana or marijuana substitutes, e-cigarettes, or personal vaporizers. If found guilty, a violation fee of $400 applies. We also reserve the right to blacklist such clients, and they will not be allowed to utilize our car rental services again.

22. Pets:

We do not allow clients to carry their pets in rental vehicles. In case a person with a disability uses a service animal, we may allow it subject to proper documentation. However, we request you to please check in with us about your service animals prior to making a booking. In case we find that you have transported any kind of animal in our vehicle or return the car with a significant amount of animal hair or with a cleaning issue that is the result of irresponsible or abusive behavior, then we will charge a violation fee of $150 in addition to our cleaning violation fee stated above.

23. Child Seats & Special Requests:

Child seats, roof racks, and other “extra” items may be available on request, although we cannot guarantee them. In case we provide you with these, there will be a fee payable to the company. Child seats are required by law, and rear seatbelts may not be available in all cars. You can check with us for these items at the time of making the booking. Moreover, any such requests should be made at the time of the booking or confirmed with us prior to the booking.

24. Deliveries & Collections:

In some cases, we may agree to deliver the car and collect it from a specified address, which will incur an additional fee. We advise you to confirm with us whether this service is available and the additional charges.

25. Driving Areas:

When taking the car to a different country/state/island, there may be restrictions that may be applicable. In this case, we should be informed at the time of booking whether you intend to take the vehicle anywhere outside the city. This may also incur additional documentation, and local charges may apply for travel to certain cities.

Cancellations

  • If you cancel more than 48 hours prior to when your rental is due to begin, you will get a full refund.
  • If you cancel less than 48 hours before, we will refund what you paid after deducting the cost of 3 days of your rental.
  • In case you cancel after your rental is due to start or you don’t show up to pick up the car, we will not give you a refund.

You may be refused the car if:
  • You don’t arrive on time.
  • You are ineligible to rent a car.
  • You don’t have the required documentation.
  • You are the main driver, and your credit card is not in your own enough, or you don’t have enough available funds on the card.

26. Amendments to Your booking:

Your booking information can be changed any time before you are due to pick up the car. In most cases, the easiest way to do it is through our website. There are no charges to change your booking, but it may affect the rental price. Sometimes the only way to change a booking is by canceling it and making another one, in which case you will be charged a cancellation fee. We will tell you in advance if changing your booking incurs a cancellation fee or changes the price.

27. Making Changes to Your Booking:

In certain cases, we may be required to make changes to your booking (after acceptance). In such cases, we will inform you as soon as possible before pick-up. In case the proposed changes are unacceptable, we will give you a full refund. However, in such cases, we will hold no additional liability in respect of any direct or indirect losses you may suffer due to these changes.

28. Driving License:

Each driver must have a full and valid driving license which they have held for at least 1 year. We will not accept expired or provisional licenses. We should be informed of any endorsements/ points on a driving license. We reserve the right to reduce bookings on this basis. Each driver must present their license at the time of picking up the car. You should also keep your license with you at all times throughout the rental.

29. Complaints:

If you are dissatisfied with our car rental services, we encourage you to let us know as soon as possible, but at least within 3 months of utilizing our service by contacting us. If you do not report your dissatisfaction timely, it will be difficult for us to assess your claim.

30. Mechanical Difficulties/ Accidents:

In case you encounter mechanical difficulties or the car breaks down, you must call us immediately. If you are involved in an accident, the local police must be contacted, and our company shall be informed. You must keep copies of all relevant documentation that you complete in case you wish to make a claim.

31. Website Conditions of Use:

Anyone is prohibited to directly or indirectly interface or attempt to interface this website using any device or software to retrieve content or other data, including prices. It is also prohibited to interfere with the normal working of this website. We regularly monitor our website access. Any person or automated systems found conducting unreasonable searches on our website will be terminated, or those persons/systems will be blocked from our website.

32. Customer Reviews:

Completed customer reviews may be uploaded to our website for the purpose of informing others of your opinion about the quality and service of our company and used partially or in entirety on our platforms, newsletters, special promotions, social media platforms, and other channels controlled by us. You consent to use your review in the above ways by submitting it. We reserve the right to refuse, adjust or remove reviews at our sole discretion.

33. Violation Fee:

If anyone is found to violate our Terms of Service policy partially or in full, a violation fee will be applicable. This violation fee applies to the Smoking policy, Pets Policy, Valeting Fee, and other sections of this policy that a client is found violating. A violation fee of $200 to $500 or as it deems fit to the violation will be applicable.

34. Modifications to Terms:

  • The Company reserves the right to modify or update these Terms at any time. Customers are responsible for reviewing the latest version of the Terms before using the services.

35. Severability:

  • If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Car Rental Agreement

This Car Rental Agreement (the “Agreement”) is entered into between the undersigned party, hereinafter referred to as the “Renter,” and Pesa Car Rental, hereinafter referred to as the “Company,” collectively referred to as the “Parties,” for the rental of a vehicle (the “Vehicle”) as described below.

The Renter agrees to return the Vehicle in the same condition as it was received, with normal wear and tear expected.

The Renter will be responsible for any damage, loss, or excessive cleaning required beyond normal wear and tear, and the associated costs will be charged to the Customer.

The Renter shall be responsible for all fuel expenses incurred during the rental period and shall return the Vehicle with the same fuel level as it was received.

Physical Damage (the actual tangible damage) to the Vehicle in the event of collision or comprehensive events, or theft of the Vehicle (and Related Costs) during the period of the booked trip, regardless of who is found to be at fault for the damage

Claims processing costs up to $150 per claim — if a third party accepts total fault for the claim and that third party’s insurer processes it on behalf of the company without substantial processing by the Companies claims administrator, we’ll refund the renter’s processing fee

The actual cash value (ACV) of a Vehicle if there’s Physical Damage that results in it being a total loss, plus Related Costs, minus the salvage value, if any.

The Renter agrees not to sublet or transfer the Vehicle to any third party without the prior written consent of the Company.

The Renter shall comply with all applicable Terms of service, laws, rules and regulations relating to the use and operation of the Vehicle.

Company’s Obligations:

The Company shall provide a well-maintained Vehicle in good working condition, with valid registration and insurance coverage.

The Company shall make reasonable efforts to ensure the availability of the reserved Vehicle at the agreed pick-up location and time.

Insurance Coverage:

The Vehicle is insured by the Company with comprehensive and third-party liability coverage.

The Renter is responsible for any deductible amount specified in the insurance policy in the event of an accident, loss, or damage to the Vehicle during the rental period.

The Renter may choose to purchase additional insurance coverage from other insurance Company or may also have the option to use their own personal auto insurance policy or credit card coverage to supplement or replace the company’s insurance. However, it’s important for customers to check the terms and conditions of their personal policies or credit card coverage to understand the extent of coverage and any limitations.

Termination:

Either Party may terminate this Agreement with written notice to the other Party.

In the event of termination, the Renter shall return the Vehicle to the designated return location promptly.

Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of California.

Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of California.

Entire Agreement:

This Agreement constitutes the entire understanding between the Parties and supersedes all prior agreements, oral or written, relating to the subject matter hereof.

Severability:

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

The Parties hereby acknowledge that they have read and understood this Car Rental Agreement and agree to be bound by its terms and conditions.
